PHC extends protective bail of KP CM, others

PESHAWAR: The Peshawar High Court (PHC) on Wednesday extended the protective bail of Chief Minister Ali Amin Gandapur, Senator Shibli Faraz, Khyber Pakhtunkhwa Assembly Speaker Babar Saleem Swati, MPAs Yousaf Khan, Atif Khan, Arbab Sher Ali, Mehboob Shah, Provincial Minister Zahoor Shah Toru, Falak Naz, and Hamida Shah.

The court also issued a notice to the federal government, directing it to provide details of the cases registered against them while barring police and other authorities from arresting them.

A two-member bench, comprising Justice Sahibzada Asadullah and Justice Sabitullah, heard CM Gandapur’s petition.

The chief minister appeared in court along with his counsel, Alam Khan, while KP Advocate General Shah Faisal Utmankhel, Assistant Attorney General Malik Danial, and NAB Prosecutor Hashmat Jahangir represented the government.

The NAB prosecutor informed the court that only one case against CM Gandapur was pending with NAB KP.

Meanwhile, the assistant attorney general submitted a report stating that 65 cases had been registered against the chief minister that included 33 in Punjab and 32 in Islamabad.

At this, Justice Sahibzada Asadullah instructed the federal government to submit a complete report, emphasizing that no additional cases should emerge later. The petitioner’s counsel requested the court to seek a report from the provincial government as well, suggesting that there might be cases against the chief minister in KP.

He cited a recent instance where cases against the party’s founding chairman were discovered in Malakand. Reacting to this, Justice Sahibzada Asadullah remarked, “This is a very alarming situation. Do not take such a weak position.

Your party is in power in the province.” The court subsequently sought a report from the KP advocate general. The PHC extended CM Gandapur’s protective bail and adjourned the hearing until April 15.

Separately, a two-member bench comprising Justice Naeem Anwar and Justice Farah Jamshed heard petitions filed by PTI leaders, including Senator Shibli Faraz, Speaker Babar Saleem Swati, and MPAs Yousaf Khan, Atif Khan, Arbab Sher Ali, Mehboob Shah, Provincial Minister Zahoor Shah Toru, Falak Naz, and Hamida Shah. The court extended their protective bail and directed the federal government to provide details of cases registered against them. The hearing was adjourned
